Covid-19 Outbreak: Practical Guidelines for Business Operators for HR Management

On April 16, AMCHAM’s Legal Committee held a video conference titled Covid-19 Outbreak: Practical Guidelines for Business Operators for HR Management with nearly 60 attendees. The event was held to help AMCHAM members learn about the wide-ranging issues currently impacting employers and how best to address challenges such as working hours, remote working, health and safety obligations, leave and pay requirements, and data privacy considerations. Komson Suntheeraporn, an Of Counsel in the Litigation and Regulatory team for DLA Piper, gave a short presentation regarding legal practice for Human Resources (HR) practices.  Komson is experienced in all aspects of commercial dispute resolution, banking litigation, contentious employment, consumer protection, trade competition, restructuring and insolvency. He started off with the legal definition of Employment Conditions for employers in Thailand as this helped listeners understand its application in different scenarios.

Komson expressed that employers needed to meet a series of requirements if changes in the Employment Conditions occur. These changes could include a reduction in pay, as that changes the conditions monetarily, or having employees Work From Home (WFH) as that changes the conditions environmentally. For both examples, employers were encouraged to receive written agreement of any changes. Komson went onto to speak about Annual Leave and Leave with Pay and further guidelines that need to be met by employers. Before answering questions from attendees, Komson commented on releasing information on employees infected with covid-19 and employers’ responsibilities to be sensitive with that information or else fail compliance with the Personal Data Privacy Act (PDPA) that goes into effect in May. He finished his presentation after commenting on a legal change that went into effect on the same day as his presentation; reduction in social security funds for the next three months.

Legal Committee Co-Chair, Christopher Knight, moderated the question and answer portion of the video conference. Members asked questions that specifically referenced their companies and opinions on how to handle employee requests. The full presentation is available on the AMCHAM member portal.
